Court Claims

(Range of fixed fees for a business to business debt that is undisputed).

These costs apply when your claim is in relation to an unpaid invoice which is not disputed, and enforcement action is not needed. If the other party dispute your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, which could be on a fixed fee (e.g. if a one-off letter is required), or an hourly rate if more extensive work is needed.

Anyone wishing to proceed with a claim should note that:

  • The VAT element of our fee cannot be reclaimed from your debtor.
  • Interest and compensation may take the debt into a higher banding, with a higher cost.
  • The costs quoted above are not for disputed claim or where enforcement action, such as the bailiff, is needed to collect your debt. If the claim is disputed/defended by your opponent and/or enforcement action is required, our fees are likely to be higher and there will be additional disbursement charges that you are likely to be required to pay, e.g. the fee for the bailiff or a court fee for the debtor to attend court for questioning.

Our fee includes:

  • Taking your instructions and reviewing documentation.
  • Undertaking appropriate searches.
  • Sending a letter before action.
  • Receiving payment and sending onto you, or if the debt is not paid, drafting and issuing claim.
  • Where no Acknowledgment of Service or Defence is received, applying to the court to enter Judgement in default.
  • When judgement in default is received, write to the other side to request payment.
  • If payment is not received within 14 days, providing you with advice on next steps and likely costs.

The time it takes to receive your instructions and receive payment from your opponent differs from case to case. On average it usually takes between 1-2 months to successfully recover monies (if the debt is undisputed). If it is necessary to issue a claim, this will invariably cause delay. Also, if enforcement action is needed, the matter will take longer to resolve.

Andrew possesses seven years post-qualification experience within the industry and is the Managing Partner of Joseph James Law. Andrew predominantly deals with cases following the commencement of legal proceedings until trial and as a Solicitor Advocate sets the tactical agenda to ensure the case has the best prospect of success. He has a simplistic, straightforward approach to legal services and also has a keen interest in technological innovations to reduce costs for clients. 1. This fee excludes any and all disbursements which may be incurred e.g. barristers fee, court issue fees etc.

2. Fee calculated based on upper bracket of claim value.
